5. Confidentiality. All elements of this Agreement and the Closed Beta Test are considered “Confidential Information” under this Agreement and may not be disclosed by you to third parties or otherwise used for any purpose unrelated to the Closed Beta Test, without the prior written consent of Licensor. Additionally, Confidential Information shall include, but may not necessarily be limited to, the following:
A. The fact that there is a Closed Beta Test.
B. The fact that you are a participant in the Closed Beta Test.
C. Any details regarding the stability of the Program, including, but not limited to connectivity, server stability, frame rates, lag, code crashes, etc.
D. Any comments regarding the appearance, look, feel and playability of the Program.
E. Any details regarding the number of people currently participating in the Closed Beta Test.
F. General comments about overall development of the Program.
G. Any comments relating to the length of time that: (i) the Closed Beta Test may last, (ii) when or whether an ‘open’ Beta Test may begin, or (iii) when the commercial release of the Program may occur.
H. General comments about the game systems utilized in the Program, including, but not limited to, combat, movement, interfaces, environments, content details, vehicles, weaponry, etc.
I. Any general comments regarding the storyline behind the Program.
J. Any contact/private information provided by you to Licensor, including, but not necessarily limited to suggestions, bug reports, etc., provided that your contact information or other personally identifiable information will be subject to the Licensor’s privacy policy (which is subject to change from time to time).
K. Any information related to private areas open only to Closed Beta Test participants, including but not limited to addresses, passwords, chat, email and message boards.
L. Any information/discussions/postings which may be located on a private Closed Beta Test message board.
M. Any comments/information that would allow people who are not currently part of the Closed Beta Test to get access to the Closed Beta Test or the Program through either legitimate or illegitimate means.
N. Any feature of the Program that is unique to the game or represents an improvement over other interactive products currently available to consumers.
